it's a state that will play a major role of course in the general election, ohio. we'll keep an eye on his comments and talk more about them later at this hour. hillary clinton getting slammed by some over comments she made to, well, to our own chris wallace on the "fox news sunday." a fat checker says mrs. clinton was not telling the truth on one answer in particular. we'll get the judge's take. andrew napolitano is coming up. there are new warnings to athletes and tourists headed to rio for these olympics we'll talk about. >> that will be something else. back to the markets. dow is dragged into the red for sixth straight day. phil flynn price futures, fox business contributor. watching oil trading in bear market territory. he is out in chicago. lori rothman on floor of the new york stock exchange. lori, to you first. august notoriously bad month for the stock market, right? nasdaq looking good right now. >> so the nasdaq is outperformer.

tech-heavy index is up five consecutive days now hitting a 52-week high during the session today. and let's look at some of the companies that really helped drive markets today. some of the support stocks if you will. amazon.com, up another 1.2%. so the lifetime high, yeah, that is a lifetime high. it was 767.74. the stock has been on a tear. online retail giant of course. gunmakers, we found interesting trend. editor charlie brady drilled on this one, way up today. smith & wesson up 3%. that is a lifetime high for the gunmaker. basically these guys are outperforming the s&p 500 index as more and more americans rushing to buy firearms in anticipation of the u.s. government likely putting in legislation to restrict gun ownership. back to you. >> lori, phil, oil dropping below the $41 a barrel mark. cheryl: said a moment ago

talking about bear market territory, 20% below the highs of the year. how low do you think can we go. >> bears had everything going their way, connell. they closed in bear market territory but couldn't close quite below $40 a barrel. that is major support. maybe tomorrow if we get back above that level we found a short-term bottom. if not, probably not. we're taking the elevator down to $38 a barrel. good news is that will drive down gasoline prices. gold was up big today. silver highest close since 2014. bad economic data here in the u.s. is good for precious metals. manufacturing numbers and construction spending plays into the mold that fed can't raise rates. good for precious metals. good day for those.

>> thank you, phil. cheryl? cheryl: dow starting a new month in the red as goldman sachs warning investors to stay away from stocks next three months. let's bring in today's market panel. jason rotman, lido isle advisors and james frischling from new oak capital. start with s&p 500 hitting this lifetime high. >> oil, drags down on some sectors of the market, but you're right, s&p on a pop. got a lot of good stories out there. we're in permanent low interest rate environment that creates a lot of issues we can talk about. the fact that certainly helps a lot of companies driving the s&p. so again there is not a lot of places to put your money now. for all the goldman sachs and jeffrey gunned lack fears and concerns where will you put your money right now?

put it in a cd and close your eyes? the answer the s&p may still be a place to put your money. cheryl: but i got to say here, the investment group looking for blue chips. past 20 years, 1.% loss. that is according to history, jason. goldman sachs saying stay away from stocks. goldman sachs don't take the prediction lightly if you will. a lot of people listen to what they're saying. >> a lot of people do. they wield a lot of clout. more importantly from accuracy standpoint, gundlach honestly has been amazing. i agree with jeff that i'm going to say something that some people may seem extreme but, today, this week, is the safest time to either sell or more aggressive, go short the market as it has ever been all year. low oil prices, market will start to digest it, say, wait a minute we can't be at all-time highs with oil at $40. connell: another story came up today that was interesting for

number of reasons, one in particular, tesla-solarcity story where tesla is being a choiring solarcity and $2.6 billion deal and they talk about cost cutting an integrating, all these kind of things and you wonder whether the companies go together. the reason, elon musk is essentdoialling a deal with, well, elon musk. does it make sense to you, the fact these companies are coming together like this. >> elon musk recused himself from the vote but something tells me it he want it to get done and it got done. two losing companies are getting together. both needs to tap the markets to fund their operations. gas at all-time low. even tesla story. the fact this is probably best thing for solarcity. i don't think they will shop to see if they can get a better bid which i do not expect they're going to find. for solarcity, folks, this is your best outcome. for ses la, folks i think you're taking on a whole lot of baggage and potential losses coming for the next several years. connell: right.

>> one plus one in this case might equal maybe two, maybe slightly less than two but not much better. connell: it is very strange. you're right he recused himself and so did other keyboard members. they talk about $150 million in cost savings and synergies they put in the first year but to jim's point, if you're tesla and tesla shareholder or work for the company or you're a customer, whatever the case may be, if tesla is your interest how does this make sense for you? >> for a lot of people tesla is not just an interest but a religion. connell: right. >> so you're not going to sell tesla if you're a fanatic. one really quick, one pro about owning tesla is that you could easily make the comparison to amazon, losing money, losing money, losing money. look at jeff bezos, he is third richest guy in the world. amazon making money hand over fist. connell: is that the comparison you're making. >> no, absolutely not. that is what tesla fanatic would say.

i think tesla will go down 20%, and then you buy it. cheryl: amc reporting earnings before the open. speaking of numbers to watch. movie theater blaming bad movies they missed on top and bottom line. stock is down 3% on the day right now. but what is interesting, jim, they had just bought star plex cinemas. eventually they will be the largest movie chain in the world. when you're a company like amc do you make a bet on movie theaters in general because amc makes the clear choice? >> there is the one to play if you like it. but i don't like it. they're blaming bad movies. i looked up prior to the last two years, down point for movie attendance was 1995. that had "water world" and "showgirls." the reason for bad attendance is bad movies, go back to 1995. revenues, are down. attendance is down. prices are down. food and beverage is down. amc, that is tough call.

they have to make the experience better. i will tell you, reclining chairs and reserve the ticket but fighting pierce competition to. cheryl: unless you're like me you fall asleep because of the darn chair. you can't top "showgirls," i don't think. let me ask you this, 2017, we're very bullish, transformers coming out, "fast & furious." things look to incomes year, things will be okay. if you believe them you buy the stock right now? >> i do believe them and i'm more of a believer buying the stock now. movie theaters have famously had very, very, very consistent revenues over the long haul even throughout the extreme media changes that the world has seen. dv. dids, netflix, et cetera. movie theaters have not really dropped ball. people still go to movies. i think the fact amc is down because of some short term blip which i believe it is it is a buy and hole absolutely, more so

had to say. >> repeal and replace. he was asked about obama care. this is interesting, trump taking questions from the audience which he rarely does. he saw him point out there, a little question and answer session. right now he is in columbus, ohio. this is part of a two-state stop today after this. he then heads to pennsylvania tonight as he he make as swing through the rust belt part of the region. trump hammers home how trade deals left american workers searching for new jobs. focusing on nafta, which was signed by then president bill clinton. he is also talking about mexico which he says is recipient of too many, manufacturing plants from america, watch. >> hillary clinton's disasterous trade policies are responsible for the manufacturing job losses in ohio and throughout the other states.

mexico is the 8th wonder of the world. that is going to end, folks. reporter: his rust belt stops come after hillary clinton and tim kaine embarked on three-day bus tour immediately after the democratic convention which she blamed trump in part for making some of his clothes overseas and not, as she put it in ohio. cheryl: she has been saying that a lot. blake burman, the man who seems to know everything. next time i have a question going to you. reporter: just a little. we were listening though. connell: thank you, blake. fight for battleground states with trump campaigning in ohio today, certainly that is a big one. the big talk is not only about ohio and pennsylvania and florida as well, seen by many as big three and must-win for trump. fred barnes joins us with the weekly standard editor. cbs, battleground tracker poll, where hillary clinton went up a little bit, but essentially close in these states. trump, first of all, he is in

ohio today. let's start there. how do things look in the state where the governor is not exactly a big trump fan? can he win ohio. >> that is putting it mildly about governor john kasich who didn't even show up at the trump republican convention in cleveland. anyway, ohio looks the best, and has to look the best for trump or he is not going to be able to win across the rust belt. in really highly competitive states. if you win ohio, that means you will have a chance of winning the slightly less republican states of minnesota, wisconsin, illinois, michigan and importantly, pennsylvania. >> right. >> but if you can't win in ohio you will not win any of those states. he really needs to concentrate on ohio which he is doing. and that is smart. connell: pennsylvania is really interesting. since president bush in '88, it hasn't gone republican. western part of the state is comparable in demographics to a state like ohio. will trump be hurt by the whole

controversy he is in the midst of now, with the khan family in those types of states with either military families or people who are very sympathetic to military causes, or is that in your view a blip on radar screen now? >> it will probably be a blip. what is trump is doing here, issue off on a tangent. not hurting him but isn't helping him. he can use it to hammer the biggest issue staring him in the face and he doesn't talk about enough, that is the economy. we know this economy, this economic recovery is the weakest in 70 years that, economic growth never gets anywhere near 3%. probably less than 2% in first half of this year. hillary clinton has adopted a program of economic status quo. she doesn't want to raise, change anything that obama is doing. connell: if he is effective, fred in that argument, wins hypothetically in ohio and does well enough to even take pennsylvania, that bring us.

to the third of the big three, argument is slightly different in florida, right? not the same type of state. >> it is not the same type much state at all. awful lot of immigrants there. you know, they're not just from cuba. there are a lot from nicaragua, puerto ricans, a awful lot of those. he has an hispanic problem there. he has one thing that helps him. old people. retirees. his coalition, in his constituency, skews old. connell: right. >> and that can help him. and of course he is one who has said, he doesn't want to fool around with social security or reform it or medicare, he wants those staying untouched. connell: sounds like mr. trump is targeting crowd with the left blinker on the whole time on 95, with the lincoln continental? thank you. cheryl? cheryl: comments from donald trump.

he just wrapped up a town hall in columbus, ohio, with live pictures. we want to listen to his response to repealing obamacare. listen. >> the numbers are so bad on obamacare, so bad, that on november 1st are going to be announced. those numbers are presidential election-changing numbers. those numbers are going to be so high beyond anything we've had, and president obama is trying to change the date to december 1st because when people see what is going to happen to obamacare, and to your health care numbers, they're so as very mom call, that people will -- astronomical. they will never vote for crooked hillary clinton. they will never vote for her. you asked a interesting question. the way you phrased it was interesting. connell: there is trump from moments ago. he will being on, mr. trump will be on "varney & company".

with what i have told the american people. >> secretary clinton said there was nothing marked classified on her emails either sent or received. was that true? >> that is not true. >> secretary clinton said i did not email any classified material to anyone on my email, there is no classified material. was that true? >> there was classified material emailed. cheryl: okay, hillary clinton, downplaying what fbi director james comey said abouter email server, that claim inning the former secretary of state, four pinocchios from "the washington post" fact check terse. that is the worst rating by the way. bring in judge andrew napolitano, fox news senior judicial analyst. your take what she said to chris wallace? >> if it weren't so serious it would be hilarious, virtually every statement she has made, or the three or four principle statements she has made are directly rebutted by the fbi director and evidence that they found. chris wallace asked very good, very well-documented questions

and by her duplicitous answers, she is created a new story for another day. so she harmed herself politically. legally, when the fbi said i was telling the truth it was an incomplete statement. the fbi director said, as far as we know she was telling truth in her three hour-secret, unrecorded testimony to us. we do not express an opinion about whether she was telling the truth to the public yet we know, because congressman gowdy who you ran, interrogating director comey under oath after he made his statement they're not going to seek her indictment, he directly reit abouted what she said. there was classified material there -- rebutted. 110 different pieces of secret and top secret material. and she tried to throw her own staff under the bus by saying i relied on their advice. we know from their testimony that she told them to establish the system through her server. cheryl: even at that hearing as we were watching it live, the republican lawmakers were already kind of looking for

reasons to call her out through director comey's testimony for not being truthful to them. that question mark seems to still be lingering. did she or did she not mislead congress? >> she clearly misled congress. she attempted to use words artfully so that she wouldn't fall in perjury trap but there are two potential problems testifying before congress. one is an outright lie. the other is literally telling the truth in such a way as to be misleading. so, when she says i neither sent r nor received anything marked classified that is literally true. the real answer however is, nothing is marked classified. the markings are confidential, secret, or top secret. did she send anything that was marked secret, or top secret? yes. 110 different documents and 52 different email streams, 25 were top secret. five sap, select access procedure, so secret, that the fbi agents investigating her

didn't have clearance to look at. cheryl: really quick judge. i have a few seconds. former nsa official speaking to breitbart, we could easily, we have the 30,000 missing emails. >> yet the fbi did not ask us for them. so how aggressive was director comey in his investigation of mrs. clinton? cheryl: he at least contradicted her somewhat in front of congress. the whole oath thing compelled him to do that. >> i would think so. cheryl: the judge. you're just the judge to me. >> you're cheryl to me. a pleasure. cheryl: connell, over to you. connell: some news coming from overseas. the u.s. has conducted more airstrikes on isis, this time in libya, targeting the city of ser of the, a primary strong hold in libya. the pentagon noting that this came at the request of the libyan government. they also point out it was authorized by president obama following recommendations from both the secretary of defense and the chairman of the joint chiefs. cheryl? cheryl: connell, what lies beneath the problem because they

connell: another look for you how the markets ended on the first day of the month of august. the dow and s&p, red arrows. the nasdaq, at 52-week high, with today's 22 point gain. keep your eye on the markets beginning today through the 31st of october. they may tell you who will win the white house in november. our friend sam stovall from s&p global market intelligence. he has been doing a little number crunching going back to 1944. what sam comes up with, if markets go up during three month period, expect clinton to win. if they go down, trump takes office. predictor has 82% success rate, 82%, not bad. we talked about hillary clinton in the polls getting a little bit after postconvention bounce, at least in this one poll that couple out, democratic candidate leading donald trump the 46-39.

this is "cbs news poll," less than one one days until the election. is this enough to convince voters? noelle schnick pour is here and richard goodstein. democratic strategist. we expect ad bounce from donald trump. we got un. maybe more than some thought. clinton back here where we started. slightly ahead with the false. >> i'm not concerned at all about her little bump. i predicted she would have a little bit after rise in the polls but what i am very glad about is that the bump wasn't a large bump. i would very, very concerned if she had like a 10-point lead but she did not. only good thing for the clinton campaign lit bump they can use it to advantage for fund-raising. i'm not worried at all. we have a long way to go. we have a long way to see exactly how the polls will shake up. look for up and down poll because we have two characters running.

we have hillary clinton, we have donald trump. so i think, there is going to be new polls every week. connell: we'll take that. two characters indeed. i was wondering how much we would agree on. even with richard nodding along, both, all three agree on that. richard, from your point of view how big after lead does hillary clinton have to have heading into the debates or would like to have? i'm assuming your thinking she will add to the donald trump with the khan family and controversy surrounding it or no? >> right. before the both conventions hillary was running about three, 3 1/2 points ahead. if this "cbs poll" is indication she actually got a larger margin after both conventions than she had before. so, we'll see how subsequent polls take into account. connell: depends on the poll. >> exactly. i totally get that. what is interesting, donald trump during, all the primaries a big part of his stump speech how he was doing in the polls. it will be interesting to see

now whether leaves that out or whether i think he will keep saying he is ahead notwithstanding all evidence to the contrary. we should expect. yesterday he said he had no relationship with putin after there were repeated tapes showing him saying he did have one. so, look, i think debates will be key. i agree with noelle there. of. having been at democratic convention i was in cleveland i think the clinton campaign did is superb job in that convention. gives me confidence they will provide rigor for the debate preparation. that will prepare her for anything. connell: that is the democratic argument this is more organized clinton campaign. heard it all last week in philadelphia. with trump seeming to trip up over the weekend again. is the campaign okay, in your view he had hadding into the fall? are they organized enough to get this done, and if the polls are right, come from behind? >> you know what? hillary clinton has a well-organized machine but think about this. so did jeb bush. he had a great organized team

and donald trump blew him out of the water. so i don't think that the trump campaign is very rattled by the fact that they're going up against a very well-organized clinton machine. connell: that is not a very bad point. that was the primary. this is the general but you're right. a lot of things have not been exactly predictable. noelle, richard, see you later on. thank you. >> thank you. cheryl: billionaires endorsing hillary clinton for president. mark cuban throwing his support behind the democratic nominee. we are just an hour away from warren buffett taking the stage with clinton in nebraska. fox news's mike emanuel, is in omaha with the latest. mike, what did clinton say about her struggles with the american public in some polls? we were just talking about that. reporter: cheryl, fascinating stuff there. she essentially accuses her political enemies of creating a caricature of her. hillary clinton says don't believe the caricature. instead focus on what she has done. >> every time i run for an

office though, oh, my goodness, all of these caricatures come out of nowhere and people began to undermine me because when i left office as secretary of state, 66% of americans approved of what i did. reporter: another poll number she doesn't want to talk about though is the latest cnn poll which said 68% of those surveyed do not find her honest and trustworthy. clinton tries to turn that around a bit saying essentially that donald trump doesn't score very well either. cheryl? cheryl: you know, mike, what is the scene like in nebraska today since you're on the ground there? reporter: it is fascinating, this is conservative state. so typically the democratic nominee does not waste anytime or energy here but this is also not a winner-take-all state in terms of electoral votes. so she could potentially win an electoral vote here if she carries one of the congressional districts. hillary clinton will be

introduced by the "oracle of omaha," buff b she had a number of big-time people come on stage and we expect her to make a similar pitch to this one. >> how many of you watched convention? [cheering] i was so proud to see democrats standing up and speaking about what we can do together to make sure the economy works for everyone, not just those at the top. reporter: her visit here has clearly excited nebraska democrats who don't get much attention typically during the general election but she is hopeful that perhaps she can get this omaha area to get one electoral vote at least from nebraska. cheryl? cheryl: we'll hear from warren buffett, the oracle, pretty soon here. mike emanuel on the ground in nebraska. mike, thank you. the battle over the white house, it is all about the economy, right, has taken a toll on the u.s. economy. companies are putting projects

on hold and reducing large investments while they wait to see if donald trump or hillary clinton will win the presidential election. this is according to "the financial times." let's bring in peter morici, university of maryland economist. i know that you get this question so much, peter, but i'm going to ask again, in your opinion, because most economists say hillary would be better for the economy. what do you say? >> most economists are academics and teach in liberal institutions, places where guys like me aren't popular. my feeling if hillary got her whole agenda and one trillion dollars increase in taxes necessary, why would anybody work? we'll have cradle to grave government, huge taxes on the people that create jobs. so how can that be good for the economy? on the other hand, if trump got his way, and we cut taxes and reduced regulation and so forth, the last time we had a president like that the economy grew at 4 1/2% a year, instead of barack obama's 2% a year. cheryl: you know what, peter? go to any watercooler in the country, you hear the same thing.

i know her tax plan is punitive, but at same time maybe she just says this to get elected and get bernie supporters behind her and she really won't do what she says she is going to do when it comes to taxes. is that a gamble you think americans might take? >> i think it's a gamble they will take, because most of them won't pay the punitive taxes. you listen to her acceptance speech. she was going after the top 1%. that is where the money is she said. the reality 84% of the taxes are paid by the top 20%. 90% perhaps by the top quarter. those are the people that are going to get nailed. they're your dentist and doctor, and so forth who will have to raise rates, what they charge you, so they can pay those very punitive taxes. after all, on top of that is the new york state tax and virginia tax, what have you. cheryl: too many taxes to go through. real quick, peter, the gdp number we got from the last quarter. we have tepid growth, no growth

connell: donald trump is bashing what i calls a rigged debate schedule. he is saying hillary clinton wants to limit the audience because two of the three debates are up against football games. we have panel with us. noelle nikpour and richard goodstein. we'll go back to the issue of the sunday night game and monday night game. two of the three would be up against the nfl. is he making a valid point? is that big deal? >> absolutely it's a huge dial. america's number one sport is football,nfl football. this is really not a good idea to hold a very important presidential debate. these debates will be very important for especially the independent voter that doesn't know which one they want to vote for. connell: right. >> this is not really fair to put it up against a big nfl sunday night, monday night game.
